Kane County Property Division Attorneys

Lawyers for Property Distribution in an Illinois Divorce
At the law firm of Mirabella, Kincaid, Frederick & Mirabella, LLC, we understand how to conduct a marital property distribution analysis for a divorce proceeding. In particular, one of our attorneys has a financial and accounting background and performs the investigative and analytical work for our divorce cases. At our law office, we do what is necessary to ensure our clients receive the marital property he or she deserves.
Problems with the Property Division Process
Illinois is considered an "equitable distribution" state. This does not mean that all marital assets will be distributed equally. Family law can be complex and frustrating enough, let alone dealing with the highly emotional state of a divorce. Our attorneys will stand by your side and help you through evaluating your assets that may be considered when going through a divorce, such as:
- Property including primary residences, vacation homes, and investments;
- Bank accounts, stock options, and retirement accounts;
- Family vehicles;
- Household furniture, artwork, and antiques; and
- Family businesses.
There are some instances where assets, called non-marital property, may be excluded from property division. Exemptions to marital property distribution include:
- Property owned before marriage or during legal separation;
- Gifts or inheritance; or
- Property excluded from a marital estate by a prenuptial or postnuptial agreement.
Property Distribution in Illinois
It is ideal that couples going through a divorce resolve their issues amicably through mediation. We encourage our clients to save themselves money by not going to trial. However, we understand that an agreement is not always possible. Our experienced civil litigators are also prepared to protect your best interests and represent you in court. Whether we stand with you in a mediation conference or before a Judge at trial, we are here to aid you with complex property division matters.
