Problems with the Property Division Process

Illinois is considered an "equitable distribution" state. This does not mean that all marital assets will be distributed equally. Family law can be complex and frustrating enough, let alone dealing with the highly emotional state of a divorce. There are some instances where assets, called non-marital property, may be excluded from property division. Exemptions to marital property distribution include:

  • Property owned before marriage or during legal separation;
  • Gifts or inheritance; or
  • Property excluded from a marital estate by a prenuptial or postnuptial agreement.
